Attention Cafeteria Plan Sponsors:

We are excited to tell you about our newest compliance package. With the recent release of proposed regulations and the previous release of final regulations, we recognize the importance of keeping our client's cafeteria plans in compliance. For a flat fee (to be determined), Hitesman & Associates attorneys and staff will inventory your existing cafeteria plan for purposes of compliance with the two final regulations and for purposes of the proposed regulations. Although the proposed cafeteria plan regulations are proposed to become effective for plan years beginning on or after January 1, 2009, plan sponsors may want to consider adopting certain elements of the proposed regulations now. The proposed regulations can be relied upon immediately pending issuance of the final regulations.

The compliance package will consist of the following:

1. inventory existing cafeteria plan;
2. make recommendations regarding what elements of the proposed regulations to adopt now; and
3. make recommendations regarding what elements of the proposed regulations to adopt in the future.
